TOTAL PROHIBITION AGAINST ADVERTISEMENT, PROMOTION AND SPONSORSHIP OF TOBACCO PRODUCTS
Resolution No. 071 of July 18, 2019, issued by the Ministry of the Popular Power for Health, was published in Official Gazette No. 41.678 of July 19, 2019 (the “Resolution”). The Resolution established the guidelines for the total prohibition against advertisement, promotion and sponsorship, and regulation of the sale of tobacco products in the national territory.
The aforesaid prohibition specially includes (but it is not limited to) external and internal areas of the establishments or points of sale; outside advertising means, billboards, posters, murals, transport stops or stations; print media; public service of open signal television, cable television, radio, internet or any other advertising means with cross-border effects; commercial establishments or public or private events, movie
theaters, auditoriums, theaters, electronic media rental spaces, museums and libraries; parks and zoos, among others.
All points of sale commercializing tobacco products must have on a permanent basis a public announcement with the dimensions and text specified in article 5 of the Resolution.
Tobacco companies may not use other alternative advertising means with the purpose, effect or possible effect of inducing individuals to consume cigarettes or other tobacco products. The sale, distribution or commercialization of tobacco products will only be permitted at the points of sale that have a valid License of Economic Activities issued by the competent authority.
Resolution No. 011, which regulates the points and methods of sale of derivatives of tobacco, and Resolution No. 012, according to which the temporary or permanent placement and the distribution or promotion of advertising media or any type of outside advertising that prompts, promotes or encourages in any manner whatsoever any form of consumption of derivatives of tobacco, both dated February 8, 2006 and published in Official Gazette No. 38.375 of February 8, 2006, were repealed.
The Resolution will become effective upon the elapsing of 60 calendar days after its publication in the Official Gazette.
