INCENTIVE FOR NEW SMALL AND MEDIUM-SIZED ECONOMIC ACTORS, NEW BUSINESS START-UPS, AND OTHER SOCIO-PRODUCTIVE ORGANIZATIONS TO REGISTER WITH THE RNC
Ruling No. DG/2021/006, issued by the National Service of Contracting (Servicio Nacional de Contrataciones), was published in Official Gazette No. 42.134 of May 25, 2021 (the Ruling). The Ruling established the incentive for new small and medium-sized economic actors, new business start-ups, and other socio-productive organizations to register with the National Registry of Contractors (Registro Nacional de Contratistas ).
The Ruling establishes the following:
(i) All small and medium-sized economic actors, new business start-ups or other socio-productive organizations that have been legally incorporated as from January 1, 2021 and that state their will to contract with the State must be registered with and enabled by the National Registry of Contractors (Registro Nacional de Contratistas – RNC).
(ii) Small and medium-sized economic actors (as defined in article 6, numbers 8 and 9 of the Public Contracting Law), new business start-ups or other socio-productive organizations will be exempted from payment of the registration with the RNC.
(iii) Small and medium-sized economic actors, new business start-ups or other socio-productive organizations must load the information required into the web page of the National Service of Contracting to be established to that end.
(iv) New small and medium-sized economic actors, new business start-ups or other socio-productive organizations that have not been able to register any amendment to the articles of incorporation with the relevant registries, may load the information contained in the same into the RNC en Línea system, which information must coincide with the registries related to the amendments. This condition will be subject to subsequent control.
(v) The RNC may audit small and medium-sized economic actors, new business start-ups or other socio- productive organizations when it deems it convenient.
The Ruling became effective as from April 7, 2021.
