DECISION N° RC.000125 ISSUED BY THE CIVIL CASSATION CHAMBER OF THE SUPREME TRIBUNAL OF JUSTICE
On August 27, 2020, the Civil Cassation Chamber, by reason of the problems caused by the SARS CoV-2 virus global pandemic, ordered the digitalization of the procedure of the appeal for cassation. The requirements for filing the formalization of the Appeal for Cassation and the brief of objection or answer to the formalization were relaxed, so that they may be forwarded to the Chamber by electronic means (email).
To that end, the Civil Cassation Chamber enabled an institutional electronic mail (secretaria.salacivil@tsj.gob.ve) to which the appellant must send the formalization of the appeal for cassation in “PDF” format and attach a brief in the same format stating the capacity in which he acts and binding himself to file the original of the same brief of formalization as sent in “PDF” format.
Once the formalization has been made, the Chamber will proceed to give notice to the other party, by electronic means, telephone, or digital means, in order to assure that said other party, if it so wishes, may proceed to file the objection or answer to the formalization through the same electronic means, in the same terms as those of the party that filed the formalization. The Chamber will place all such acts on record in the physical file through a printed writ.
With this decision, as others that have been issued in the last years, the Chamber continues with its effort to simplify the requirements, formalities, and procedural steps of the Civil Cassation procedure.
