DECISION N° 0078 ISSUED BY THE CONSTITUTIONAL CHAMBER OF THE SUPREME TRIBUNAL OF JUSTICE

The Constitutional Chamber of the Supreme Tribunal of Justice issued Decision No. 0078 of July, 7 2020 (Case: JUAN ERNESTO GARANTÓN HERNÁNDEZ), which suspended for 90 days the application of any regulatory instrument issued by the city councils and legislative councils of the states that establish any type of rate or contribution of a tax nature, as well as any decree or administrative act of general application issued for the same purpose by mayors or governors.

The Constitutional Chamber also ordered the Sectorial Vice-president of the Economic Area and Minister of the Popular Power for Industries and Production to form a technical work group with the governors, mayors, and the head of government of the Capital District in order to coordinate the parameters within which their taxation power will be exercised, for the harmonization of the matters referred to tax rates and aliquots.
