Regulation of Procedure of Examination and Final Inspection for Exportation
A Joint Resolution of the Ministries of the Popular Power for Finance, for Defense, for Water and Air Transport, for Agriculture and Lands, for Health, and for Commerce (the “Resolution”) was published in Official Gazette No. 40,269 of October 10, 2013. The purpose of the Resolution is to facilitate the procedure for exportation of goods produced in the country. In this connection, the examination, inspection, and comparison of documents to be made for said export goods will be jointly made by the authorities of the National Integrated Service of Customs and Tax Administration (Servicio Nacional Integrado de Administración Aduanera y Tributaria – “SENIAT”) and the Customs Law Enforcement Authority (Resguardo Nacional Aduanero) of the Bolivarian National Guard and the Anti-drug Command of the Bolivarian National Guard, as ancillary entities.
As to the places to carry out the examination and inspection, the Resolution establishes that unless the competent entity, due to the nature of the goods to be exported, determines in the permit or authorization of exportation that the examination, inspection, and comparison of documents are to be made in the primary zone, the exporter may choose that they be made in the premises of the interested party or forward the cargo directly to the warehouse zone of the primary zone of the exit customs, subject to the procedures and rules established in the Resolution.
