National Constituent Assembly
The following Decrees were published in Official Gazette No. 6.295 Extraordinary of May 1, 2017:
Decree No. 2.830 whereby the President of the Republic called for a National Constituent Assembly, indicating that the members of the Original National Constituent Assembly would be elected in the sectorial and territorial ambits, under the direction of the National Electoral Council, by universal, direct, and secret vote.
Among others, the following are proposed by the President of the Republic as programmatic objectives of the National Constituent Assembly: (i) Peace; (ii) Perfection of the national economic system, conceiving the new model of mixed, productive, diversified and integrating post-petroleum economy, on the basis of the creation of new instruments that revitalize the development of productive forces, as well as the establishment of a new model of distribution for supply to the population; (iii) Constitutionalization of the missions and great Socialist missions; (iv) Broadening of the competence of the Judicial System; (v) Constitutionalization of the new forms of participative and proactive democracy, on the basis of the recognition of the new subjects of the Popular Power, such as communes and communal councils, workers’ councils, among other forms of territorially and socially-based organization of the population; (vi) Defense of the sovereignty and integrity of the nation and protection from foreign interventionism.
Decree No. 2.831 whereby the President of the Republic created the Presidential Commission that will be in charge of preparing a proposal for the territorial and sectorial electoral bases, as well as for the principal aspects that will serve as a basis for the structure and operation of the National Constituent Assembly, after consultation to the broadest sectors of the country, guaranteeing the direct participation principle established in the National Constitution. Likewise, it was established that within a fixed period of time as from the date when the Decree becomes effective, said Presidential Commission will present to the President of the Republic a report with the grounds, results, and recommendations obtained in the exercise of its powers.
This Decree will become effective upon publication of the same in the Official Gazette.
