Medical Services & Health Centers
Official Gazette No. 40,196 of June 26, 2013, publishes the official Ruling No. 294 (the “Ruling”) issued by the Superintendence of Costs and Prices (“SUNDECOP”) by which (i) the rendering of medical services are categorized; (ii) the procedures for the filing of private health centers in the National Registry of Goods and Services (the “Registry”) are established, and (iii) the prices of medical services therein indicated are determined.
The most relevant matters of the Ruling are the following:
- Rendering of medical services: the attention through actions addressed to guarantee the health of citizens, including diagnosis and the treatment of sicknesses, as well as the rehabilitation of their consequences, in order to maintain, enhance and recover the population’s health, by which the private health centers receive a compensation that will satisfy its exchange.
- Private Health Center: private establishments, regardless of the legal figure under which they may operate, and that are dedicated to the prevention, diagnosis and treatment of sicknesses, as well as the rehabilitation of their consequences in order to maintain, enhance and recover the population’s health, duly authorized by the Ministry of the Popular Power for Health; notwithstanding the classifications that may be established by the Executive Power.
Regimes of registration of the providers of health medical services. Private health centers must file their registration with the Registry, in a period of thirty (30) continuous days counted as of the publication of the Ruling in the Official Gazette, and provide the information that may be required through the Automated Service of Administration of Prices (the “System”).
Notification of costs and prices. Private health centers must notify the costs and prices of the services they render or have rendered as of May 31, 2013, to the Registry, through the System, in the terms and conditions that may be established in the forms or web page established by SUNDECOP to such effect. The costs and prices notified by the private health centers must correspond to those effectively charged by the services they render as of May 31, 2013.
Regime of control and determination of the prices of health medical services. Until SUNDECOP does not fix its prices, those that render private health services, must receive, as compensation for such services, the prices determined in the attachments of the Ruling, which include all the structural elements, technical equipment and human manpower required for medical attention and in function of the terms therein established, excluding medical fees.
Finally the Ruling was effective as of the date of its publication in the Official Gazette.
