Certificate of Contributor and Non-Contributor to FONACIT

Administrative Ruling No. 012-085, issued by the National Fund of Science, Technology, and Innovation (Fondo Nacional de Ciencia, Tecnología e Innovación  - “FONACIT”), was published in Official Gazette No. 40.281 of October 28, 2013.  Said Ruling establishes the requirements and procedures that are to be complied with for the obtainment of the Certificate of Contributor and Non-contributor (the “Certificate”) corresponding to the obligation of payment of the contribution established in the Law that governs the matter. In this connection, the interested party must file, personally or through a duly authorized agent, the documentation described below according to the relevant procedure:

 

1.  Requirements to apply for the Certificate.

-   Certificate application form.

-   Copy of Fiscal Information Registry (R.I.F.)

-   Copy of document of registration with the Mercantile Registry.

-   Copy of IT return corresponding to the calculation base for compliance with tax obligation.

 

2. Requirements for renewal of Certificate.

-  Certificate application form.

-  Copy of Fiscal Information Registry (R.I.F.)

-  Copy of expired Certificate or Certificate with a date close to expiration.

-  Copy of IT return corresponding to the calculation base for compliance with tax obligation.

-  Copy of bank deposit or electronic transfer voucher indicating item of  payment.

 

3. Procedure before the competent Administrative Unit

-  After the analysis of the documentation and verification of the tax clearance certificate of the applicant, a report will be issued showing the status of the taxpayer, within the two (2) following business days.

-  Any omission or fault will be notified within the three (3) business days following receipt of the application. The applicant must remedy the omissions or faults within fifteen (15) business days following said notification. 

-  Once the requirements established in the Ruling have been met, the Certificate will be issued within the three (3) following business days.

-  The Certificate must contain the information established in article 11 of said Ruling and will be valid for one year.

 

4. Other significant aspects 

-  The information provided by the applicant must be updated annually or when modified and it will have the character of a sworn statement.

-  FONACIT may request any additional document that it deems necessary.

-  Any discrepancy in the information will result in the declaration that the application is not admissible.
