Resolution that regulates the National Registry of Work Entities

Resolution No. 9,108 of March 30, 2015 issued by the Ministry of the Popular Power for the Social Process of Work (the “Resolution”) was published in Official Gazette No. 40,655 of May 7, 2015. Said Resolution resolves to regulate the National Registry of Work Entities (Registro Nacional de Entidades de Trabajo - “RNET”).

 

The RNET is obligatory for all work entities of the country, public and private, of social and of mixed ownership.   The registry will keep the data relating to the social process of work and to social security and all matters relating to the labor clearance certificates will be placed on record in the same.

 

The operation of the RNET will be made in an automated manner. It will be a single registry with a public and obligatory nature, for the consolidation and concentration of the data provided by the work entities of the country in connection with the social process of work and with social security, which information will serve as a base for the labor clearance or non-clearance certificates.

 

All work entities of the country, public or private, of social and of mixed ownership, established in article 45 of the Organic Law on Labor and Workers (“OLLW”) are under the obligation to be registered with the RNET.

 

The work entities registered with the National Registry of Companies and Establishments (Registro Nacional de Empresas y Establecimientos - “RNEE”), as per Resolution No. 8,100 of November 29, 2012, published in Official Gazette No. 40,064 of December 4, 2012, must access the RNET in order to update their data within a period of ninety (90) business days as from the publication of this Resolution.

 

The work entities established in article 45 of the OLLW are under the obligation to carry out their registration within a period of one hundred and twenty (120) business days following publication of this Resolution.

 

The following Resolutions are repealed: (i) Resolution No. 4,524 published in Official Gazette No. 38,402 of March 21, 2006, with a partial amendment as per Resolution No. 8.100, published in Official Gazette No. 40,064 of December 4, 2012; and, (ii) Resolution No. 4,525 published in Official Gazette No. 38,403 of March 22, 2006.

 

The Resolution became effective upon publication in the Official Gazette.
